Is online casino legal in Azerbaijan? Law, fines and legal alternatives

Short answer: no. Casinos have been banned since 1998; organising an online casino is a crime and taking part is an administrative offence, with a 3 000 ₼ fine for players. Both penalties were made tougher in summer 2026. Below is what the law says, who faces which penalty and the legal options.

Where the ban comes from

Casinos were banned in Azerbaijan by the presidential decree of 27 January 1998 «On measures in the field of combating economic crime». The decree closed casinos, betting shops and games with cash prizes. The reasons given were harm to the economy, the risk of money laundering and the negative effect on young people.

The ban later moved into the codes: organising gambling became a crime under Article 244-1 of the Criminal Code, and taking part became an administrative offence under Article 525 of the Code of Administrative Offences. Lotteries and sports betting regulated by law are the exceptions.

Liability of players: Article 525

Article 525 sets a fine of 3 000 ₼ for taking part in gambling. The gaming equipment, the money or property staked, the winnings, prizes and other income are confiscated as well. The code has no separate article for virtual gambling, so lawyers point out that playing at an online casino also falls under Article 525.

In July 2026 the Milli Majlis adopted an amendment to the code in the third reading: if the offence is repeated within a year of the penalty decision taking effect, the fine is 5 000 ₼ or, depending on the circumstances and the person, administrative arrest of up to 15 days. Confiscation applies in both cases.

Liability of organisers: Article 244-1

Organising and running gambling is a crime. Under the previous wording the penalty was a fine of 10 000-15 000 ₼ and up to 2-3 years of restricted liberty or prison. The amendments approved by the President in July 2026 explicitly cover organising through the internet, mobile networks, social media and other electronic means, and make the penalty tougher: a fine of up to twice the criminal proceeds and 2-4 years of restricted liberty or prison. With an organised group or large proceeds it is 3-5 years, and with especially large proceeds 5-8 years in prison.

Advertising and promotion

Advertising unlicensed gambling and unregistered lotteries also brings administrative liability. Social media pages that spread «earning schemes», «Aviator signals» and casino links are risky in this sense, and the «guaranteed income» they promise is in most cases a scam.

The law recognises two exceptions. The first is lotteries run under the Law on Lotteries; the state operator is Azerlotereya, and its online platform is Misli.az. The second is sports betting under the Law on Physical Culture and Sport, offered by licensed operators such as Topaz. Playing with these operators is legal, winnings are paid officially, and disputes are settled under Azerbaijani law.

Online casinos, slots and live dealer games are not covered by these exceptions. There are no locally licensed online casinos.

What a foreign licence means

The casinos in our catalogue hold licences from foreign regulators such as Curaçao, Anjouan, MGA or Gibraltar. Such a licence allows the operator to work in that jurisdiction and lets players complain there. In Azerbaijan a foreign licence does not make playing legal and does not remove liability under Article 525. In our reviews we treat a licence as a way to complain in a dispute, not as proof of legality.

Blocked sites

Access to unlicensed gambling sites is restricted in Azerbaijan at the provider level. Operators respond by opening new addresses called «mirrors». Using a mirror does not change the legal status of playing. On top of that, fake sites spread under the name of mirrors: they accept deposits, never pay out and collect card details.

Payments, winnings and tax

Banks often decline card transactions in the gambling category. Winnings on a foreign site can be confiscated under Article 525, which means the law does not protect them. Tax on winnings from licensed lotteries and sports betting is governed by the Tax Code; check the exact rules in its current version.
